On Feb. 11, 2008, The U.S. Court of Appeals for the 7th Circuit, in Chicago ruled that the newer statute of No Child Left behind overrides the earlier decisions of Individual of Disabilities Act. Details of the article are for subscribers of the periodical. Because this is a hot topic we will be following it closely.

The No Child Left Behind Law requires that special ed students are part of the AYP subgroup. This is contrary to IDEA’s individual education program requirement. The most recent reauthorization of IDEA was in 2004. These amendments were to bridge IDEA to the NCLB law not to replace it. Since its reauthorization their have been many conflicts between the two laws.
